Kyle Elden Mrofka was a supervisory U.S. Border Patrol agent.
The case against him traced back to a 2013 encounter at the Picacho State Recreation Area in California.
Mrofka was roughly 10 years older than the teenage girl involved. She was reportedly 14 or 15 at the time and later described his behavior toward her as “grooming.”
Years later, while Mrofka was working as a supervisory Border Patrol agent in Arizona, California authorities issued a warrant for his arrest.
He was arrested in 2017 and placed on indefinite suspension without pay.
Mrofka was initially charged with felony counts of lewd and lascivious acts with a minor.
But those aren't the charges he was ultimately convicted of.
In 2019, Mrofka accepted a plea agreement and pleaded guilty to the reduced charge of misdemeanor statutory rape.
He was sentenced to three years of probation.
No prison.
He was also ordered to complete a sex-offender rehabilitation program and stay away from the victim for 10 years. Under the plea agreement, he was not required to register as a sex offender.
The distinction matters: the original felony allegations were reduced through the plea deal.
So does this:
A federal law enforcement supervisor pleaded guilty to a sex offense involving a teenage girl and walked away with probation.
